Florida Family Law: COVID-19 and Social Media

As all of us attempt to adjust to the “new normal” of working from home, children out of school, or minimizing social contact in order to stop the spread of COVID-19, it is easy to turn to social media to distract from the uncertainty outside our homes.  If you are thinking of going through a divorce, are already in the midst of a divorce, or are co-parenting with a former partner, be cautious about posting on social media if you and your partner or co-parent are having difficulties getting along.  If you have told your child’s other parent that you are keeping your child with you, perhaps contrary to a parenting plan you may have in place, yet you are documenting your child having play dates with other children or in public places in even small groups, that may come back to haunt you.  Another example – if you have posted about feeling ill or having a cough, yet days earlier your social media shows you at a bar with friends, it is likely that your co-parent or partner may insist on a 14 day quarantine to ensure that you are not contagious or inadvertently spreading COVID-19 to more vulnerable members of the community.  In other words, your social media posts can be (and likely will be, if you are in a contentious case) used against you in court so protect yourself, and more importantly your children, by following local and national guidelines for health and safety and communicating honestly about them with your partner or co-parent.
